According to court documents obtained by InTouch Weekly, the actors, who share two young children, have agreed to limit their alcohol consumption when in the presence of their children. This deal comes after Prepon accused Foster of struggling with alcohol abuse, specifically alleging that he often "day drinks." In her response to Foster's request for a temporary custody schedule, she also requested that he refrain from drinking 12 hours before or during his time with their children.

Foster's lawyer, Rose Palermo, strongly denied Prepon's claims, calling them "falsehoods" and "disturbing fiction." Palermo further stated that Prepon’s actions could harm their children, emphasizing that Foster has always prioritized their well-being. The custody arrangement and the allegations against Foster have been a source of tension, and it is evident that the actors are navigating a difficult and complicated divorce process.

The couple, who had been married for six years, announced their separation in November 2024, with foster filing for divorce, citing "irreconcilable differences." According to sources, the two have already been living separately, with Prepon residing in Tennessee and Foster in Los Angeles.
